Hague-Visby Rules는 Hague Rules의 결함을 보완하고 시대에 적합하도록 개정한 개정판(改訂版)이지만 Hamburg Rules는 Hague Rules 원칙을 근본적으로 바꾸고 새로운 질서를 수립하기 위한 조약임이다.
함부르크 규칙은 선진 해운국 중심의 헤이그 규칙 내지 헤이그-비스비 규칙을 폐지하고 하주국인 개발도상국의 이익을 충분히 반영하는 새로운 법질서를 창출하려는 의도에서, 국제연합무역개발회의 중심으로 하여 성립되어 1992년 11월 1일에 발효되었다.

In accepting this bill of Lading, the Merchant (as defined by Article 1 on the back hereof) agrees to be bound by all the stipulations, exceptions, terms and conditions on the face and back hereof, whether written, typed, stamped or printed, as fully as if signed by the Merchant, any local custom or privilege to the contrary notwithstanding, and agrees that all agreements or freight engagements for and in connection with the carriage of the Goods are superseded by this Bill of Lading.
