A Study on the Improvement of the Statutory Urban Planning and Development System

Over the past three decades of rapid urbanization, Korea have been formulating its urban planning and development system. But in these days it is considered that urban plannig and development system should be restructured because of its maladjustment in socia-economic aspects. To confront theses requirements, those roles of planning and development must be reestablished through reviewing the existing problems and by comparing with those of foreign advanced nations.
This study is divided into three major parts. In the first part, we clarified several factors in the legislative urban planning and development system which cause the problems surrounding urban development. And the second part deals with the characteristics of urban planning and development systems in the foreign advanced nations and tried to find out the current change characteristics in the urban planning and development system. In the third part, we propose several recommendations by the conclusion of this study.
The major recommendations of this study are as follows:
1) To introduce the two tier system of development permission and the structure planning instead of the current one tier and top-down system. The development permission system shoud be managed to be corresponded to the everyday changing market conditions and the structure planning should be not blue-print planning, but strategic planning.
2) To make 「urban development law」which covers the procedure and the execution of the large urban development project. And the existing statutory urban development system shoud be integrated under the new「urban development law」.
3) The spatial planning system should also be rearranged by introducing the structure planning. The zoning and the urban planning of public facilities should be managed under the directions of structure plan, but should be implemented to manage the built-up area developed by the development permissions or the projects on the basis of 「urban development law」.
