any case in which an agency makes or has made available through the Internet a record with respect to an individual (including a case in which a record was available through the Internet before the data of the enactment of this Act) and such individual suffers harm as a result, the individual may bring a civil action against the agency and such action shall be treated as a suit under section 552a(g)(1)(D) of such title.
(c) DEFINITION OF RECORD- As used in this section, the term 'record' means any item, collection, or grouping of information about an individual that--
(1) is maintained by an agency with respect to the education, financial transactions, medical history, or employment history if the individual; and
(2) contains the name or the identifying number, symbol, or other identifying particular assigned to the individual.
ABSTRACT
A study on the protection of consumer privacy in electronic commerce

Electronic commerce refers to trade in goods and services by open network such as the internet which has immense potentials.
Recently, there have been many studies on electronic commerce. But most of these studies were focused on the supplier side rather than the consumer side. This study deals from the viewpoint of consumers with the issue of privacy, one of the most important factors with regard to the development of electronic commerce .
The purpose of this study is then to promote development of electronic commerce by representing the ways of protecting consumer privacy and hence decreasing total transaction costs between suppliers and consumers.
To begin with, the paper reviews the theoretical background of privacy, discusses the infringements on privacy in electronic commerce, and surveys recent developments concerning privacy protection in international organizations (e.g., OECD and EU) and major countries.
Based on these preliminary studies, the following suggestions are made to better protect electronic privacy.
First, general principles on consumer privacy like OECD's privacy guidelines and EU's directives of data protection should be established.
Second, the government should establish a privacy law concerned with both the public and private sectors. There is no legislation regulating the infringement on privacy by private sector agents in Korea.
Third, the government should educate consumers and electronic commerce businesses on consumer's privacy rights.
Forth, a self-regulatory privacy protection mechanism adopted among private electronic commerce businesses may play an important role.
Finally, arbitration may be preferable to formal litigation as a dispute resolution procedure in case of privacy infringement.
If consumer's privacy is protected well in these ways, the potentials of electronic commerce will be more fully fledged before long.
