규제체계는 미국과 동일한 형태를 유지하고 있으나, 실질적인 규제업무 수행정도는 선물업계의 의견을 대변하는 수준에 그치고 있다. 선물업계의 공정거래 질서 및 공정경쟁의 여건을 마련하기 위해서는 업계의 실정을 정확하게 파악하고 있는 민간 전문기관을 통한 자율규제 기능을 강화할 필요성이 매우 높다. 특히 시장참여자들과의 직접적인 접촉을 통해 선물시장의 장기적이고 전문적인 발전을 위한 실질적이고 현실적인 규제 업무를 수행하는 미국의 NFA와 같은 선물협회를 중심으로 한 업계의 자율규제가 절실하게 필요하다.
