1. MAJOR RESEARCH QUESTION
One potential scenario regarding the future of North Korea is state collapse and unification with South Korea. Effectively isolated from the international community and the world economy, bereft of the great power patronage that it once enjoyed from the Soviet Union and China, and enduring endemic economic shortages and distress, Pyongyang faces challenges that may cumulatively lead to its dissolution. Were collapse to occur, many surmise, unification with the South seems a plausible consequence.
Unification of the Korean peninsula by the South’s absorption of the North, nevertheless, faces numerous obstacles. This thesis will assess the international legal and institutional problems involved in such a scenario. Specifically, it will estimate the probability of a North Korean collapse, examine the legal and institutional factors of state succession as they apply to the two Koreas, assess the relevance of similar historical cases of state succession, and analyze relevant aspects of United States policy toward North and South Korea and those of the South Korean government.
