한 보상 여부에 대한 기준으로서 사회적 수인을 넘어선 과도한 희생 또는 형평성이라는 법리를 보다 구체화할 필요가 있다. 사회적 수인의 개념은 재산권의 가치 하락으로 여기는 것이 보다 간명하다. 물론 재산권의 가치하락을 어떻게 평가하느냐라는 문제가 있을 수 있지만 그것은 대체적인 용도의 이용 가능성이라는 하부기준이나 외부성의 유형 기준 등을 통하여 점차 해결해 나갈 수 있을 것이다.
