최신표준계약서사례

무역표준계약정의는 국제판매매매계약(International Sale of Goods)은 국적을 달리하는 당사자간의 합의를 기초로 하여 발생되는 매도인과 매수인의 법률상의 권리 및 의무를 규정한 것으로서, 매도인이 그 물품의 제공을 약속하고 매수인이 화폐를 물품의 대가로 지불 할 것을 약속함으로 성립 하는 국제간의 물품매매 계약을 의미한다.
- 승낙계약(Consensual Contract)：당사자 일방의 청약에 대하여 상대방이 승낙함으로써 성립하는 계약을 말한다.
- 쌍무계약(Bilateral Contract)：계약 성립과 동시에 매매당사자가 채무를 부담하는 계약으로서 수출자는 수입자에게 상품인도의 의무가 있고 수입자는 수출자에게 대금지급의무가 있다. 그러므로 계약 성립에 따라 쌍방이 채무를 부담하게 되는 계약을 말한다.
